Three questions always face the creditor’s rights attorney when attempting to collect a client’s debt. How much of the debt can I reasonably collect? How quickly can I collect? And perhaps most importantly, how much is the client going to have to pay me for my collection of the debt? This program will be different from other collection seminars with panelists who represent both debtor and creditor sharing their expertise. We will also have a view from the bench to gain a broader perspective of how to collect and also successfully defend against collection. You will learn how an attorney can responsibly deal with clients in order to maximize the collectability of a debt while ensuring that a reasonable fee may be expected for the work expended. The speakers will analyze techniques for reviewing client’s files and for preparing demand letters and pleadings. They will discuss methods of collection, how to use the court system to collect judgments and alert you to possible violations of the Fair Debt Collection Practices Act. Practitioners who deal with collection issues on an irregular or semi-regular basis will want to take advantage of this opportunity to brush up on collections strategies.
