Drunk Driving: Detection, Prosecution & Defense

This program focuses on the detection, prosecution and defense of DUI and refusal cases from the initial police contact with the suspect through the trial and disposition of the case. The program consists of two distinct three hour sessions. You may choose to attend one or both sessions. The morning session provides a comprehensive nuts and bolts analysis of DUI and refusal cases and focuses on the basics of DUI and refusal cases. This session will be taught from the perspective of a municipal prosecutor, defense attorney and police officer. It includes the following: • Basic components of a DUI case; • Basic components of a Refusal case; • Demonstration of standardized field sobriety tests; • Prosecution of a DUI case; and • Defense of a DUI case. The afternoon session moves beyond the basics of DUI and refusal cases. The speakers will include a representative from the Department of the Attorney General, a representative from the Department of Health, a drug recognition expert and defense counsel. This session includes the following: • Certification of breathalyzer operators and breathalyzer machines; • Prosecution of a Refusal case at the RITT; • Issues beyond the basics of DUI cases; • Issues beyond the basics of Refusal cases; • Confrontation clause and blood testing; and • Drug Recognition Expert presentation. Throughout both sessions important cases, typical scenarios and practice pointers for both DUI and refusal cases will be analyzed and attendees will receive the 2014 DUI Practice Manual.

You may register for either the MORNING or AFTERNOON sessions or for the FULL DAY. Lunch is not included. Please be sure to check the appropriate box.

This program is appropriate for both new and experienced attorneys. You may register for one or both sessions. The full day CLE program has been approved by the National College for DUI Defense (NCDD) to meet its membership rules requirement.
