This program will focus on the application of the Medicare Secondary Payer Act (MSP) to Liability and No Fault cases.

It will include a detailed discussion of the October 2017 changes to the Medicare Common Working File, the November 2017 educational outreach by CMS to the medical community and what that may mean for your cases, as well as anticipated MSP enforcement changes expected in 2018.

In addition to:

  • review techniques to ensure the settlement does in fact remain secondary to Medicare, such as use of a Medicare Set Aside
  • the risks of failing to maintain Medicare as a secondary payer
  • intersection of MSP, legal, and privacy issues which may lead to ethical quandaries, claims and risks
  • the statutory requirement to reimburse Medicare’s conditional payment
  • the multitude of avenues available to seek a reduction of the conditional payment amount
  • information on both the BCRC and the CRC
